Welcome to the website of the New York Yoga Teachers Association (“NYYTA”). Access to, and use of, the NYYTA website constitutes acceptance of the following general terms and conditions.

Please note that NYYTA reserves the right to change any of these terms and conditions without notice.

PRIVACY

NYYTA is committed to protecting the privacy of its users. This privacy policy (“Policy”) explains the information NYYTA collects when users visit the website, and how NYYTA collects, uses and protects such information. This policy does not apply to offline activities. From time to time, NYYTA may modify this Policy. Continued use of the website after modification of the Policy indicates agreement to the modified terms.

Anonymous Information. NYYTA may collect anonymous information about users who visit the website and aggregate this anonymous information for statistical analysis. Examples of the type of anonymous information NYYTA may collect include internet tags and IP addresses. Please note that NYTTA could use this information to identify a user if necessary to comply with legal requirements or for security issues.

Personal Information. Personal Information includes information such as a user’s name, address, telephone number, email address, credit card number and credit card expiration date. NYYTA collects Personal Information only when a user voluntarily provides it to NYYTA on our Site, such as during online purchasing transactions, sign up to subscription services, or membership registration. Users may need to provide Personal Information to participate in certain NYYTA programs and activities or to receive certain services or offers. Please note that online purchases may require users to provide Personal Information to a third-party service provider on its website. Users should read the privacy policy of the third-party site before providing any Personal Information. On registration, users must provide NYYTA with accurate and complete registration information, and it is the user’s responsibility to update and maintain changes to any Personal Information.

Multiple IDs not allowed. When users register to the services offered by NYYTA and pay a membership fee, a username and a password must be set-up. Users should only register once. Users are responsible for any use of the website made by anyone using the user’s username and for preventing unauthorized use of the username.

Use of Personal Information. NYYTA will use a user’s Personal Information for the purpose for which it was given to NYYTA (e.g. to complete an online purchase, subscription, or membership). NYYTA may use a user’s Personal Information to send postal and/or electronic mailings about NYYTA and its programs and third parties that NYTTA believes may interest the user. NYYTA may share Personal Information with third parties that perform services for NYYTA, such as fulfilling magazine subscriptions, conducting membership mailings or providing postal and electronic mailing platforms and services. NYYTA also reserves the right to disclose any Personal Information in circumstances that NYYTA deems necessary or appropriate, including a response to legal process or request from a governmental agency, security reasons or similar situations.

Opt out. Users may “opt out” of receiving marketing information sent by NYYTA by unsubscribing to the mailing list, following instructions in the applicable information sent to you, or by contacting NYYTA at info@nyyta.org

Security. NYYTA strives to keep all Personal Information secure and safeguard it from unauthorized access by using Secure Socket Layer encryption to protect credit card numbers, firewalls to protect servers, and virus/intrusion detection software. However, users provide Personal Information at their own risk.

Payment. Any payment information sent to NYYTA over the Internet is encrypted using 128 bit Secure Socket Layer (“SSL”) technology. SSL is currently the preferred method to securely transfer credit card data over the Internet.

LIABILITY DISCLAIMERS

Information only. NYYTA provides only information on this website to users, not medical advice. Information at this website is not intended as a substitute for medical/health care or advice. Users should consult a physician before beginning any new exercise program. NYYTA is not responsible for information contained in this website. NYYTA cannot and does not guarantee the accuracy, integrity, or quality of any of the information provided on the website.

Injury. NYYTA does not favor, promote or recommend any particular method, teacher or yoga discipline represented on the website. NYYTA assumes no responsibility for injuries suffered while practicing any of the techniques or following any of the advice, statements or information listed on the website.

Non-endorsement. NYYTA provides a listing of teachers, events, benefits available to members (eg: health insurance information), volunteers, classified advertisements, etc. as a service to its users. A listing here does not imply an endorsement by NYYTA. NYYTA’s website may include links to other third party websites. Any links are provided only as a convenience and do not imply any endorsement of another site. NYYTA is not responsible for the availability or content of third party sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such third party sites. NYYTA is not responsible for a user’s choice of teacher.

Attendance of events. NYYTA makes no guarantees, promises, or endorsements with respect to any events posted on the Events Calendar and the attendance of such events.

Warranty and liability disclaimer. To the extent permitted by law, NYYTA makes no representations or warranties, express or implied, with respect to the website, or any portion thereof, including any warranties of title, noninfringement of copyright, trademark or patent rights of others, merchantability or fitness or suitability for any purpose. In no event will NYYTA be liable for any injury, loss, claim, damage or any incidental or consequential damages arising either directly or indirectly out of or in any way connected with its Site. NYYTA disclaims responsibility for any errors or omissions, including technical inaccuracies or typographical errors. Furthermore, NYYTA cannot and does not guarantee or warrant that files made available for downloading will be free of “viruses”, “infections” or similar software contaminations which may render the software useless or cause damage or destruction to a user’s hardware, software and any system(s). Users are responsible for implementing sufficient procedures and protections against possible damage. Use of NYYTA’s website is at the user’s own risk.

Message Boards. NYYTA includes discussion forums that allow interaction between users (“Message boards”). NYYTA does not moderate or regulate the Message boards. While NYYTA does not control the information or materials posted in the Message boards by users (the “Messages”), it reserves the right to delete, move or edit the Messages and to terminate user access to and use of the Message boards at its sole discretion without notice. Users waive any moral rights that they may have with respect to the Messages. NYYTA cannot guarantee the accuracy, integrity or quality of any Messages. Some users may breach these terms and conditions and post Messages that are misleading, untrue or offensive. Users’ bear all risk associated with use of the Message boards. If a user believes or knows that a Message infringes any person’s legal rights, NYYTA should be notified immediately with specific details at info@nyyta.org

User Rules. Users are solely responsible for the content of their Messages. In order to maintain an efficient and effective website that addresses the needs and interests of its users, the following rules apply to the use of NYYTA’s website, including but not limited to, the Message boards:

1. Users may not post, link or transmit any Message that is unlawful, threatening, abusive, libelous, defamatory, pornographic, or obscene, or violates any other person’s copyrights, privacy rights, trademarks, trade secrets or rights in any confidential information, or which contain any other form of illegal content. The user hereby indemnifies NYYTA for any and all damages suffered by third parties as a result of user’s violations of this rule.
2. Users may not post or transmit Messages with the intent to threaten the safety of others and/or with the effect of causing a reasonable person to perceive a threat to his or her safety.
3. A user who posts information to this website represents that it is the sole owner of these materials or that is has the right to license their use.
4. Users acknowledge and agree that NYYTA may take appropriate action in order to prevent the misuse of the website to disseminate information, statements or materials that may be abusive, destructive, harmful, or threatening to the safety of others or in order to comply with any law or regulation of any government entity.
5. Users may not interfere with other users’ use of the website, including, but not limited to, the disruption of the normal flow or use of the service. Users may not restrict or inhibit any other user from using the Chat rooms.
6. Users may not post or transmit any contaminated or destructive files.
7. The use, distribution, or publication of any materials posted by third parties does not constitute or imply an endorsement of such materials or of any opinions or comments expressed in such materials.
8. Users may not impersonate any person or entity or misrepresent any affiliation with any person or entity.
9. Users hereby grant NYYTA a perpetual, worldwide, irrevocable, royalty-free, non-exclusive license to use, reproduce, modify, publish, perform, display and distribute its posting, any portion of such posting and any derivative works created from such posting, in print, electronic and other media, by any means now known or developed in the future. NYYTA shall delete all identifying information relating to users in the subsequent use(s) of such postings.

Use of Materials. Users may download, print or transmit information from the website subject to the following conditions:

1. the appropriate copyright and/or trademark notice must be affixed to each copy downloaded, transmitted or printed;
2. the use of materials available from the website must be for personal or informational purposes only and may in certain instances be used for commercial purposes;
3. materials available from this website may not be modified in any manner;
4. no materials available from this website (including links from pages or other websites) can be used, copied or distributed separately from the accompanying text

Classifieds / Volunteers. Members posting classifieds or volunteer listings agree:

1. to post information that is in all respects true and not, in any respect, misleading, deceptive, inaccurate, or likely to mislead or deceive;
2. to notify or remove any posts if the Member becomes unavailable for employment or volunteering, or if the goods/services are no longer available for purchase or sale;
3. that all arrangements between Members and third parties as a result of any posts are made at the parties’ sole risk and responsibility;
4. that third parties are responsible for determining the suitability of Members for jobs and for their own recruitment procedures and policies and that NYYTA has no responsibility for the same. Members are responsible for, and will indemnify NYYTA against, claims brought or allegations made against NYYTA by a third party and any damage, liability, losses, costs (including legal fees) suffered by NYYTA in respect of a third party’s use of any classifieds or advertisements posted by said Members to third parties. NYYTA has no control over third parties and no liability will be accepted by NYYTA in relation to the acts of a third party. Members agree that NYYTA shall have no liability to the Member that said Member may incur as a result of the negligence, dishonesty, or misconduct of any third party and agree to hold NYYTA harmless against the same.
